Riverside Charter Amendment
Shall Section 4.04 of Article IV of the Charter of Riverside be amended as follows: SECTION 4.04 VACANCIES, CREATION OF The Council shall be the judge of the election and qualifications of its own members. Upon complaint and hearing in accordance with Constitutional standards of due process, Council may sanction, discipline or remove any member of Council who by vote of at least five members of Council is found by clear and convincing evidence:(1) To have ceased being a qualified elector and resident of the Municipality as required by the Charter; (2) Has entered upon the performance of the duties of an incompatible public office;(3) Holds any appointed office or employment with the Municipality for which compensation is authorized;(4) Has violated any express provision of this Charter; (5) Has been convicted of a felony or other crime involving moral turpitude;(6) Has been convicted of any violation of State law for which the applicable penalty includes forfeiture of office; (7) Has engaged in gross immorality, gross misconduct, malfeasance, or nonfeasance in office, has willfully and flagrantly exercised authority or power not authorized by law, has refused or willfully neglected to enforce the law, or has grossly neglected official duties. Alternatively, Council may by a vote of five of its members, approve the filing of a complaint with the Probate Court of Montgomery County in accordance with Ohio Revised Code Section 733.72. Such complaint shall be sworn under oath by one member and signed by four other members.The complaint shall charge any of the following:A. That a member of the legislative authority of the municipal corporation has received, directly or indirectly, compensation for his services as a member thereof, as a council member, or otherwise, contrary to law;B. That a member of the legislative authority or an officer of the municipal corporation is or has been interested, directly or indirectly, in the profits of a contract, job, work, or service, or is or has been acting as a commissioner, architect, superintendent, or engineer in work undertaken or prosecuted by the municipal corporation, contrary to law;C. That a member of the legislative authority or an officer of the municipal corporation has been guilty of misfeasance, or malfeasance in office.
